Minority oppression and enemy or vested property act in Bangladesh

By Jahangir Alam Akash, General Zia and his predecessors introduced persecution against the minorities in Bangladesh. Bangladesh became Islamized under the military regime, rather than being a true parliamentarian democracy. Bangladesh was not born with the blessing of being united beyond ethnic and religious differences, but rather has been Islamized, yet with a secular policy.
Why is the repression of minorities and indigenous peoples still going on in Bangladesh? Bangladesh's Awami League is now in power. They have always gotten the minority and indigenous votes, with some exceptions. And it has been 38 years since Bangladesh became independent. Enemy or vested property is a great black law and it’s a gross tool for minority repression. Our demand is that, immediately this black law should remove and the property should refund to the real owners or their relatives.

Religious minority oppression is a common phenomenon in Bangladesh. Every day, minority oppression is growing at an alarming rate. Yet our government is not doing its duty to safeguard the minority groups. Why aren't they doing something to stop minority torture? We don't know. But we have been seeing that most of the perpetrators are linked with the ruling party. People think that the present government may be turning a blind eye at minority issues. We have seen than happen in the cabinet and the central committee of the Bangladesh Awami League. We want to say clearly that the people do not want to see the issue ignored, but rather, that they want to see peace and happiness.
In Bangladesh, the brutal persecution of the Hindu, Christian religious minority and indigenous ethnic minorities is going ahead full steam. Until now, the persecution that both communities faced never saw the light of justice. A culture of the denial of justice in Bangladesh is the root of all the persecution against the ethnic and religious minorities, which isn't only affecting a part of the country, but is plaguing the entire criminal justice system in Bangladesh.
The torture of minorities continue to happen in Bangladesh. When will it come to a stop, and why doesn't the government take action against the perpetrators of minority torture? In Bangladesh, every day, there have been cases of murder, attempted murder, torture, and other forms of inhumanity. Is Bangladesh a democratic and civilized country? How can we say that it’s a civilized and democratic country? Without human rights or the rule of law, how can we say that Bangladesh is a democratic country?
In Bangladesh, crimes against humanity have become widespread, especially against minorities. Almost every day, minority people leave for our neighbor country, India. Minority women are constantly afraid for their security. Peace, good governance, rule of law, and democracy are nonexistent in Bangladesh. Almost every day, perpetrators get impunity from the state. As a result, there is a constant increase in all kinds of bad activities in our dear Bangladesh. At the same time, sectarianism has increased very rapidly. And our religious minorities are suffering.
Majority Muslims are occupying the minorities' lands, torturing them, and raping their women. It is a common practice. Everything has been happening in front of the eyes of the government. The present ruling party is always telling us that they are nonsectarian. Yet, they are failing to stop minority oppression, and the torture of minorities is still happening in Bangladesh.
We see from the media that ruling party members are taking away land that belongs to minorities. The people of Bangladesh have not forgotten the oppression of minorities that took place after the general election of 2001. It is true that our minority peoples faced grievous trouble under the BNP/Jamaat-E-Islam alliance government that ruled from 2001 to 2006. During that regime, BNP/Jamaat party members were committing murder, rape, and vandalism against minorities.
Bangladesh was born as a nation after nine months of fighting for freedom. With independence, four main components were established for the nation, namely, democracy, nationalism, secularism, and socialism. With an almost good constitution, Bangladesh was beginning to make progress forward. However, the constitution did not recognize our indigenous communities. Even today, indigenous peoples are not recognized by the constitution.
But, within four years was breakdown and to stooped our first constitution by the national and international conspiracies with the help of anti liberation force. The present government has the support of the majority in Bangladesh; if they wanted to reestablish the 1972 constitution, it would be no problem to do so. But the government has been in power for seven months, and they still haven't taken any steps in this direction.
Under the force of Islamization, the preamble of Bangladesh's constitution has been amended to include the words "...pledging that the high ideals of absolute trust and faith in the Almighty Allah...", and, in the process, the word "secularism" has been dropped. The constitution, in fact, begins with the words "Bismillah-ar-rahman-ar-rahim", which means "In the name of God, the Compassionate, the Merciful," which words come from Islam. In Bangladesh, the completion of Islamization is happening everywhere.
In this situation, we demand that the unconstitutional provision concerning a state religion in relation to the Constitution of Bangladesh be repealed. All activities of discrimination, disparity, arrests, torture, detention, and oppression against religious minorities, as well as all people in general, shall have to be stopped. We don’t want a religious state; we want a secular and democratic state, bereft of all disparities, based on Bengali nationalism in the light of the four fundamental principles of the state that motivated the Bangladesh Liberation War for independence and that constituted the dream of the father of the nation, Bangabondhu Sheikh Mujibur Rahman.

Jammat-E-Islam is a communal party in Bangladesh, which was involved with war criminalities. BNP also has been upholding their non-secular attitude, which was introduced ‘Bismilla’ to our secular constitution. So, BNP-Jammat has beat-torture or kills to the minority, it’s a natural. That we have seen in last BNP-Jammat alliance government regime. Both of two parties have doing their politics using by religious faith and feelings. We want to draw a little picture on minority killings, tortures in the present government regime. Though, this government has well known as a minority friend government. In spite of this regime minority repression has going on. It’s very unfortunate to secular peoples.
The Local Influential boycotted & cut the hair of a Hindu-Dalit raped victim because Muslim perpetrator raped her. Ms.Sabita Rani (25) a raped woman prayed for punishment of rapist- Jewel Kha and as a result the powerful social leaders cut her hair and boycotted herself and her family members. The leaders also threatened her mother and younger brother for dire consequence if she continues to stay at the village Nilam Kharida Sadar Taluk within Kaonia Upazila of Rangpur district in Bangladesh. A college girl Koli Goswami (21) was kidnapped and forceful conversion at Ghosai Chandura, Upazila - Nandail district-Mymensingh on 13th June.
According to the oldest Benglali newspaper the daily Sangbad, Properties belonging to minorities in the Sherpur District were occupied by force by a Juba League leader, while shops were demolished and women injured. A group of hoodlums under the leadership of Hafizur Rahman Hafiz and his elder brother, Azizur Rahman Aziz, the cultural secretary of the Juba League occupied by force 283 square meters of land belonging to a Hindu owner, Surjya Kanta Debnath. In connection with this, allegations were made by the victim’s family that two shops were demolished and that their daughter, Ms. Lipi Debnath, was physically assaulted. Twenty minority families from the Sonagazi-Feni district are on the run because of the continuous kidnapping of women and children and the forceful collection of money. More than 20 minority families located in the villages of Kazir Hat and Keramatia, in the Sonagazi Sub district of the Feni district, are absconding dues to continuous threats and atrocities perpetrated by local Muslims. They left their homes from fear of impending attacks. According to the daily Star, "Rajshahi board boss faces mayor's fury," the Mayor of Rajshahi Khairuzzaman Liton recently was threatened to the Rajshahi Board Chairman Dr. Prodeep, because his daughter couldn’t good result in SSC examination.
We want justice for all kinds of killings, torture, and human rights violations. Under the present government, at 50 incidents of minority torture have taken place, including the sensational kidnapping of nine minorities (including women and children) in the Sutrapur area of Dhaka. A gang of criminals attacked three Hindu families in the Dighalkandi Sahapara village of the Puthia Upazila of Rajshahi on the night of Aug. 31, 2009, injuring 12 people. The attackers belong with BNP-Jammat. A Hundi women Radha Rani Halder (28) in Shoriotpur was gang raped recently. And three minority peoples were killed in this regime.
The patriotic journalist Manik Saha was killed by a bomb attack in 2004. Another honest journalist, Diponker Chakraborty from Bogura, was killed by terrorists. From Faridpur, the promising journalist Goutam Das was killed. Principal Gopal Krishna Muhury was killed by being shot. All Bengali people know about the young minority girl named Purnima who was gang raped in Sirajgonj. And these were all preplanned incidents. No actual investigations have taken place and punishment has still not been given to the perpetrators of crimes against at least 15 indigenous community leaders, including Alfred Soren and Choles Ritchil.
We know Bangladesh has no actual democracy, rule of law or education. Most of the people are living in very poor conditions. The obvious problem is that, constitutionally, Islam is the only religion of Bangladesh. But in Bangladesh, there live Muslims, Hindus, Christians, and Buddhists. We have had a secular constitution since our country's independence, led by the father of the nation, Bongobondhu Sheikh Mujibur Rahman. After the killings of Bongobondhu, General Zia, and General Ershad, the most important principles of the constitution were abandoned.
We hope that the present government will take immediate action against minority and indigenous persecution. And our demand is that all the perpetrators should be punished. But now there is a democratic government. So, what is the problem in stopping minority torture and extrajudicial killings? Let us be united and fight and pressure the present government to stop minority repression and state torture. Otherwise, minority torture and state torture will not stop.
We want the legitimate demands of the aboriginal and tribal communities to be fulfilled, including the preservation of their distinct cultures and heritage, and the implementation of the Chittagong Hill Tracts Peace Treaty. We want the return of vested property, with a provision of inheritance, to be implemented. We want the government to resist sectarianism, fundamentalism, and fanaticism and to put a stop to all kinds of religious discrimination, deprivation, atrocities, persecution, and harassment.
The attack on the religious minority brings with it the idea of “Islam in the constitution”. The communal spirit began with political motives and ended in mass destruction such as the attack on present Prime Minister Sheikh Hasina Wazed back in 2001. The victims of the brutal attack are still looking for justice. At that time also, a bomb attack killed 10 and badly injured 20 others at the Baniarhar Catholic church in Maksudpur, in the Gopalganj district.
In 1998, an indigenous leader, Alfred Soren, was brutally killed by those in power. The day of the attack, the perpetrators looted his house, destroyed his belongings, and set the house on fire. Until now, his family members and the public have never seen the light of justice. Cholesh Richil, an indigenous Christian leader, died in custody on March 18, 2007, following brutal torture at the hands of the army. Richil’s civil rights were grossly violated by government agents. It is puzzling why the government has not yet made a proper investigation to unearth the mystery behind this leader’s death. The perpetrators of this crime should not have impunity. The killing of Richil has not been filed as a criminal case to date.
From 1979 to 1981, the indigenous people of Bangladesh became cornered by landless people from the mainland in the process of their rehabilitation by the government. An ill-fated ten-year-old indigenous child, Klanto Chiham, was killed by brutal teachers after being tortured at Maymansingh. A dacoit, or robber, killed a Christian school teacher, Mangsang, at Madhupur in Tangail. A member of an even smaller minority, Dr. Goni Gomes, a converted Christian from Islam, was killed by Islamic militants.
We urge the enlightened citizens of Bangladesh to be united and to do something about minority rights and security. Please forget politics. As human rights defenders, we should be impartial, universal, and dedicated to human rights.
The constitution does not give proper identity to the indigenous peoples. This is Bangladesh! We demand that these persecutions stop right now and that the government give all rights due to the minority groups and bring the perpetrators to justice. Without real democracy, rule of law, and good governance, how can anyone have hope that the government will punish the real culprits and masterminds of minority torture and other human rights violations? We are waiting eagerly for the execution of war criminals, of the killers of Bangabondhu Sheikh Mujibur Rahman, and of the killers of the four national leaders. We also want to see the current government reestablish the constitution of 1972 and stop mixing politics with religion.
Prime Minister, and daughter of Bangabondhu, Sheikh Hasina, please open your eyes to the minority community. Don't you see what is happening? You have power as the prime minister; why don’t you take action against the perpetrators of minority suppression? You still have time to use your power. Please safeguard our minority peoples and their possessions.
Lastly, we want to demand that the government immediately form a public inquiry committee to investigate all cases of minority oppression and human rights violations that have occurred since independence. To only investigate is not enough; we think that those involved with minority oppression and human rights violations should be punished and made into examples. Otherwise, it will never be possible to establish the rule of law. If the government wants to take these actions, then it should, first of all, reestablish our 1972 constitution. Secondly, it should immediately bring to trial cases involving war crimes, jail murders, and the Bangabondhu murder case, and should punish the accused. It also needs to take strict action to stop Islamic militants. Otherwise, we have no alternative before us to establish peace and happiness.

“MPism” and press freedom in Bangladesh

By Jahangir Alam Akash, In Bangladesh, press freedom is facing attack by the lawmakers of the ruling party, the Awami League. One after another, journalists have been attacked by members of the ruling party, but the government hasn’t taken any action against them. The killing, torture and oppression of journalists are all common in Bangladesh. The present government made a commitment to the people to provide for free mass media. But its actions haven’t followed its commitment. The latest journalist tortured victim F M Masum is a staff reporter for the national English daily Ne Age. He was brutal tortured by so-called elite force RAB. Before this Patuakhali incident aside, there has been a recent rise in harassment, either in the form of physical torture or filing false cases. At least 130 journalists have fallen prey to various types of harassment since January. Two journalists were killed, 46 injured, 11 assaulted, 13 attacked, one abducted, 43 threatened and three sued in the past eight months up until August. Unidentified terrorists at Mirer Bazar in Gazipur killed the executive director of Samprotik Somoy, Ahsan Bari, on August 26. A total of 25 journalists have been killed in last 16 years in Bangladesh. After receiving naked threats, two journalists from Patuakhali and Chuadanga fled their home districts with their families. The flown journalists are Israt Hossain Lipton from Patuakhali and Shah Alam from Chuadanga. Both of them work for the Bengali daily newspaper, Prothom Alo. Furthermore, the government has withdrawn the cases against members of the ruling party on the grounds of being politically motivated by the former caretaker government. Yet, the politically motivated and fabricated cases against journalists filed under the same regime are still pending, even though the government declared that cases against journalists would be withdrawn. The ruling party cadres have also kept three more journalists confined–Sankar Lal Das, Patuakhali correspondent for the Prothom Alo and ABC Radio; Khondokar Delwar Jalali, Patuakhali correspondent for Channel One; and Hanjala Shihab, Patuakhali correspondent for Digonta TV–in an attempt to prevent them from covering the issue of “river grabbing,” where influential people encroach upon and take control of the river, to the detriment of others. The Benapol correspondent of the Daily Sangbad, Debul Kumar Das, was seriously injured by a group of criminals at Benapol in Jessore on Aug. 13, 2009. In Chuadanga, the Amar Desh correspondent, Dalim Hossain, has been put behind bars after a party lawmaker, Solaiman Haque Joarder Salon, and his brother, the mayor of the municipality, Reazul Islam, filed a case on September 1 against 80 people, including two journalists, Dalim Hossain and Shah Alam of the Prothom Alo. Mr. Motiur Rahman, a prominent pioneering journalist and the editor of the Prothom Alo, wrote a column about the present situation of press freedom in Bangladesh. (Source: Prothom Alo, Sept. 17, 2009). I congratulate him on his informative write-up. Under the BNP-Jamaat regime, hundreds of journalists were brutally tortured, and many were killed. Mr. Rahman is very well-known. He has played a prominent role in the media world in Bangladesh for a long time. When the journalists of the Prothom Alo were attacked, he raised his voice against the repression of journalists. Under the past caretaker government, many journalists were brutally tortured by the army. Even cartoonist Arifur Rahman of the Prothom Alo was arrested, due to pressure from Islamic groups. Tasneem Khalil of the Daily Star was brutally tortured by the Directorate General of Forces Intelligence. And I was also illegally arrested, detained, and inhumanely tortured by the RAB under the same regime. Still, I have been facing two false and fabricated cases. I was victimized by four fabricated and politically motivated cases under the caretaker government. Our hope is that the government protect the freedom of the press, according to their commitment. Without press freedom, we can’t even imagine a democracy. So, for peace, rule of law and democracy, it is essential to safeguard press freedom. We have to demand that the government please bring to the justice all the perpetrators of killings and torture and protect human rights, democracy, peace, rule of law and the constitution. We don’t want “MPism”, but we want to have peace, rule of law, real democracy, equality and justice.

Dignity and Amnesty International's new campaign

By Jahangir Alam Akash, Every person has dignity. For an individual’s dignity is a very important component to living in a civilized society. But the individual’s dignity has been hampered in various ways. A lack of democracy and the rule of law is, every day, violating the dignity of the individual around the world. This is especially common in Asia.

Due to human rights violations, terrorism, militancy, poverty, undemocratic attitudes, corruption, discrimination, intolerance and injustice, human dignity has been hampered all over the world. So, every civilized society and state needs to uphold human dignity.

If every state and society respects human dignity, then peace and happiness will come into the world. In spite of the fact that the UN's Universal Declaration of Human Rights ensures human dignity, most of the countries of the world has been violating it.

We can say that human dignity indicates a person's basic needs for living. It is a universal responsibility for every government to provide people their basic needs. But we have seen that most of the governments of the world haven't provided for their peoples' fundamental needs.

Insecurity, injustice, inequality, poverty and the lack of democracy, accountability and the rule of law are the main barriers to upholding dignity in the world. Many people have no food, clothes, housing, clean water, sanitation, education, health, nutrition and human rights. Asian peoples especially have been facing great challenges regarding human dignity.

During the present global economic crisis, Amnesty International has started a Demand Dignity Campaign with an aim to end global poverty by working to strengthen recognition and protection of the rights of the poor. The campaign will demand the leadership, accountability and transparency, which are essential to end the human rights violations that keep people poor. Thanks to Amnesty International for their activities to reduce poverty.

With gross poverty, inhumanity, inequality, injustice and without other fundamental rights, how can we even imagine human dignity?

Who will suffer next from RAB brutality?

By Jahangir Alam Akash, Another journalist was brutally tortured by the so-called elite force, the Rapid Action Battalion (RAB), in Bangladesh. Tortured journalist F.M. Masum is now under treatment in a private hospital in the capital city of Dhaka. Before this, he had been admitted to the Dhaka Medical College Hospital. After being tortured, he can no longer hear with his left ear. Masum is a staff reporter for the national English language daily newspaper, New Age. He was tortured on Oct. 22 in his house in Dhaka. Different media and human rights organizations demanded a judicial inquiry into the torture of Masum. After every incidence of the torture of journalists, like Masum’s case, journalists and human rights organizations give a condemning the act and demanding an investigation. But we think that only condemning the torture and demanding an investigation is not enough. To prevent more torture, there needs to be exemplary punishment of those who are responsible for these incidents. The Bangladesh Nationalist Party’s secretary general, Khandaker Delwar Hossain, also condemned the torture of Masum and demanded legal action against the personnel involved in the incident. It is very funny, because their government (the BNP-Jamaat alliance) created the RAB. RAB activities are totally inhuman and unlawful. But our blind media has always covered false statements given by the RAB and the police regarding so-called “crossfire” killings without investigation. So, the RAB knows that journalists are always publishing false reports about their illegal operations. That is why the RAB is gaining the courage to torture journalists. At least 50 journalists have been tortured by the RAB since 2004. This is not a new history of brutal torture by the RAB. The RAB also illegally arrested, detained and tortured inhumanely with electric shocks myself, the editor of Human Rights Today in 2007. Here are some links to videos about my torture by the RAB: http://www.youtube.com/watch?v=1xzaCRYCkqs (BIHR part-1) http://www.youtube.com/watch?v=BthGnl-WEGo (BIHR part-2) http://www.youtube.com/watch?v=hnyyJHp3ET0 (BIHR part-3) http://www.youtube.com/watch?v=H1G8BUvZ_mc (”Unbearable Time”) Here is some background of the torture of Masum: According to a report by New Age, the Rapid Action Battalion, on Oct. 22, 2009, had tortured severely New Age staff correspondent F.M. Masum, keeping him in detention at the RAB-10 headquarters at Dhalpur in Dhaka for about 10 and a half hours. The battalion men picked Masum up from his rented house at Jatrabari in Dhaka at noon and severely tortured him in public. Masum was, however, released at about 10:30 p.m., reportedly after repeated interventions by the home minister and the home secretary, and he needed to be rushed to the Dhaka Medical College Hospital for treatment. According to Masum and spot accounts, a battalion team raided the house at 67, Dakshin Jatrabai, where Masum lives as a tenant, at noontime for alleged involvement by the landlord in drug peddling. The battalion personnel also knocked on the door of Masum’s flat. As soon as Masum opened the door, the battalion personnel slapped him, accusing him of being late in opening the door. They started torturing Masum severely as he told them his identity, according to spot accounts. Torturing him in public on the spot, the battalion men rubbed salt in the wounds and took him to the RAB-10 headquarters at Dhalpur. “At the RAB office, they tortured me inhumanely saying, ‘We are taking our anger at Nurul Kabir [the New Age editor] out on you,’ Masum said in the hospital. Soon after Masum’s detention, different battalion officers came up with different stories as the reason for the detention. Some of them claimed Masum was found in possession of Pethedine, some said it was Phensidyl (codeine) syrup, while others said they found him with prostitutes. The New Age people were asked earlier to sign an undertaking that declared that Masum had been involved in drug trading for a long time, but his colleagues refused to sign it. Masum also said that the battalion personnel had videoed arranged sequences of the seizure of drug substances from his room. He was also videoed along with the wife of the owner of the house. Any torture is a violation of UN’s Universal Declaration of Human Rights and the Constitution of Bangladesh, while torture is a criminal offense. The government should immediately abolish the RAB, and bring to justice all those who were involved with tortures and killings. Torture, Journalism & BangladeshWhy and how I was tortured by RAB? Personally, I have also been victimized by the recent past authority for my activities as a journalist, writer and human rights activist. I was tortured for 15 hours. My crime was that I was made several investigative reports about the RAB’s offenses of extrajudicial killings, Islamic militancy and Indigenous and minority torture as well as corruption and political terrorism. I want to paint a picture of the violation of the rule of law and human rights in Bangladesh. The RAB arrested a terrorist named Benazir on May 2, 2007, on the charges of possession of illegal arms. While arresting him, they shot both of his legs in front of his minor daughter and his wife. Benazir is now crippled with two bullet marks on his feet. He is also detained in the hospital area of the Rajshahi central jail. The RAB did not find any arms in his possession. Another killing was happened in the name of ‘Encounter’ by RAB-5. RAB murdered a local Workers party leader Maznu Sheikh alias Kamrul Islam at Chotobongram in Rajshahi city on May 18, 2007. I reported about these on CSB News and broadcasted interviews of their relatives (wife, mother, brother and localities). In the same time I was published these report on the daily Sangbad and broadcasted in DW Radio. When Benazir was shot, it was reported by me on CSB News. None of the RAB personnel who were involved in the alleged operation agreed to give statements in front of a television camera regarding the incident. In the evening, I send the report to our head office in Dhaka from our bureau office in Rajshahi. In a news bulletin broadcasted at 1:00 a.m. the following morning, the report was broadcast. Then, at 9:33 p.m. that evening, I received a call from RAB officer Major Rashidul Hasan Rashid. Soon as I As soon as I picked up the phone, the caller asked me why the broadcasting of the news piece about the RAB’s operation was stopped after being aired only twice. In reply, I told him that “it is up to the head office.” Major Rashid became annoyed with me and said, “You broadcasted this report intentionally.” I replied, “It is my professional duty, nothing more than that.” He asked, “Why did you broadcast someone crying and the statements of Benazir’s wife and daughter?” In response, I asked him, “Do you want to know it officially?” At this stage, Major Rashid became very rude. I cannot mention the words he shouted at me in our language, since the language was very bad. He was outraged and said, “If you fail to give the right answer about why you broadcast the report, then I shall take actions against you.” I said, “I have not committed any crime.” Major Rashid asked again, “Why did the other TV channels not broadcast the same report? You did it intentionally and your actions belong to ‘anti-state activity’.” He also said, “Make sure that you, any of your colleagues, and the CSB News camera are never seen within the jurisdiction and activities of the RAB. If they are, then the RAB will take action against you.” After that, he hung up. I complained to the Asian Human Rights Commission and Amnesty International regarding this threat. Then an investigation was commissioned. After giving a detailed report, I signed my written statement, which was received with signature and official chop by the reader to assistant police commissioner in Boalia, Rajshahi on July 3, 2007. Mr. Golam Mostofa, the field officer of the National Security Intelligence questioned me regarding the said intimidation and threats, on July 15, 2007. Then, at around 6:00 p.m. on July 22, 2007, Mr. Moyeen, an inspector of the Special Branch of the city of Rajshahi visited my office and took my statement. Inspector Moyeen also asked about the threat I felt, and I replied that the RAB is involved in extrajudicial killings and I feared that I could become the victim of such a killing. I reported that I have been continuing my work, but I still worried that the RAB or his men might target me for further harassment or intimidation. So I became a target. I have been charged multiple times with false and political motivated charges and have been arrested, tortured and detained. I was arrested from my house at midnight and tortured in front of my wife, child and rental house owners. I was taken to the RAB-5 office. I was hung from the ceiling with my hands tied with ropes and was beaten mercilessly on my feet and my back. I was kept hanging from the ceiling with ropes around my hands, with the mask on my face. And also they gave me electric shocks. When I was being tortured I was being shouted at with words like: “Will you do the Benazir report again…?” “Litchi garden report again…” ‘Khairuzzaman Liton’s family report again…” Now face the consequences; son of a pig… son of a bitch…” etc. The RAB would like to be able to kill me, and officially call the killing a “crossfire” or “encounter.” RAB sent me to the local police with the charge under the section 16(2) of Emergency Power Rules 2007. I was under medical attention in the Rajshahi central jail for 10 days. As a new detainee, I was sent to the case table in front of the jail house’s trial court on my first day. When I went to case table, two fellow inmates had to hold me on both sides. I had no power to walk. I could not even sit properly, but could only put pressure on one side of my rear, when sitting. I broke into tears. Many cases were lodged against me. I felt I was being prepared to be killed in a “crossfire” or “encounter.” There is more shocking news I have learned about a key perpetrator, Major Rashidul Hassan Rashid, an RAB military officer who played the leading role in the extrajudicial killings of Ahsan Habib Babu, a student’s league leader; Kamrul Islam, alias Maznu Sheikh, a Workers Party leader; Ali Jafor Babu, a prominent businessman; and about twenty others. Some people like Benazir and a jail guard, Shahebul Islam, were highly affected and disabled by their torture. Major Rashid has been recruited to serving in the U.N. peacekeeping mission in the Ivory Coast; he joined the UN mission on July 10, 2008. This makes it clear how well the Bangladeshi authorities look into human rights abuses and treat the victims and the perpetrators. This personal history it’s a black chapter in my life. In conclusion we want to say that, the so-called crossfire, encounter or gunfight stories which made by RAB-police are totally false than reality. Terrorism never combat or control by state killings, we believe. Establish to rule of law is very essential for control to terrorism. Killings without justice! http://www.humanrightstoday.info/?p=1345 By Jahangir Alam Akash, The term “extrajudicial killing” means execution without justice. This is a grave human rights violation. It’s both a violation of Bangladesh’s constitution and of the UN’s Universal Declaration of Human Rights. But these types of killings still occur frequently in Bangladesh. The State Minister for Home Affairs and the Prime Minister of Bangladesh openly support the extrajudicial killings, despite the fact that Bangladesh signed the Universal Declaration of Human Rights and the Convention Against Torture. Not only that, the constitution of Bangladesh also safeguards the right to life. The government of Bangladesh has been violating the constitution and Universal Declaration of Human Rights since 2004. According to Art. 35(5) of the constitution of Bangladesh and Art. 5 of the Universal Declaration of Human Rights, “No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.” And according to Art. 3 of the constitution of Bangladesh, “Everyone has the right to life, liberty and security of person.” But, in practice, Bangladesh does not ensure the right to life and has not complied with the Universal Declaration of Human Rights and the constitution of Bangladesh. We can see that state institutions such as the judiciary, the rule of law, regulations, the constitution and the national assembly have been disabled. The media’s role regarding extrajudicial killings covered up under reports of “crossfire”, “gunfights” or “encounters” is negative and constrained. The media has only been publishing the normal reports about these encounters filed by the RAB or the police themselves. A few human rights organizations have long been asking the government to stop the killings, terming them “extrajudicial”. Moreover, the High Court of Bangladesh, on June 29, 2009, asked the government to explain why killing people without a trial, in the form of extrajudicial killings, is not being declared as illegal, and why measures are not being taken against the perpetrators. After this ruling, we still haven’t seen anything happen. Extrajudicial killings continue even in violation of the High Court’s ruling. How can they continue? It’s very alarming for human rights, democracy and the right to life. And why is the High Court silent regarding this gross human rights violation? Both governmental and nongovernmental sources have said that the death toll has reached 115 from such extrajudicial killings - labeled as “crossfire” killings, “encounter” killings or “gunfight” killings by the Rapid Action Battalion (RAB) and the police - since Jan. 6, when the Awami League-led government assumed office. In Bangladesh, we have a so-called democracy, but there is no rule of law. Every day sees more killings of citizens by the state machinery, killings which are both well-planned and covered up. The government of Bangladesh has been violating the constitution and the Universal Declaration of Human Rights day after day since 2004. In 2004, the BNP-Jamaat government made a decision about extrajudicial killings and formed the RAB. From March 26, 2004 until Oct. 21, 2009, around 1,600 people have been killed without justice. The government of Bangladesh has sided with the extrajudicial killings. Prime Minister Sheikh Hasina has also said, in an indirect way, that extrajudicial killings will continue. She spoke clearly, upholding “crossfire” killings. What was said by our popular Prime Minister Sheikh Hasina in New York is very unfortunate for the rule of law, democracy, the constitution, and the Universal Declaration of Human Rights, as well as the people of Bangladesh. (For more information, go to http://www.humanrightstoday.info/?p=1267) Sheikh Hasina talked with journalists in New York on Sept. 27, 2009. Referring to “crossfire” killings at the time, she said, “I do not believe in extrajudicial killings. But if anyone launches an armed attack (against a law enforcer), then they shouldn’t be allowed to kill them like sitting ducks.” (Source: Bdnews24.com) In conclusion, I want to say that the reports of so-called “crossfire” killings, “encounter” killings or “gunfight” killings that are made by the RAB and the police are totally false. I believe that terrorism should never be combated or controlled through state killings. It is the establishment of the rule of law that is essential to control terrorism.

Minority peoples face persecution

By Jahangir Alam Akash, In Bangladesh, the brutal persecution of the Christian religious minority and indigenous ethnic minorities is going ahead full steam. Until now, the persecution that both communities faced never saw the light of justice. A culture of the denial of justice in Bangladesh is the root of all the persecution against the ethnic and religious minorities, which isn't only affecting a part of the country, but is plaguing the entire criminal justice system in Bangladesh.

General Zia and his predecessors introduced persecution against the minorities in Bangladesh. Bangladesh became Islamized under the military regime, rather than being a true parliamentarian democracy. Bangladesh was not born with the blessing of being united beyond ethnic and religious differences, but rather has been Islamized, yet with a secular policy.

The constitution does not give proper identity to the indigenous peoples. This is Bangladesh! We demand that these persecutions stop right now and that the government give all rights due to the minority groups and bring the perpetrators to justice.

New trend of minority repression in Bangladesh

By Jahangir Alam Akash, The Trend of fraudulent conversion by Muslims personifying Hindu adolescent girls increased abnormally at Joypurhat in Bangladesh. In those areas, a sense of insecurity prevails amongst the Hindu communities due to such unabated trend. The local administration also failed to give adequate protection to victim families of Hindu communities.

Ms.Purnima Rani –daughter of Dulal Roy of Chitra Para-Joypurhat town was missing having false promise of matrimonial function with Hindu boy. The Muslim perpetrator is a relative of a very powerful Juba League Leader of Joypurhat. Ms.Purnima Rani could not be recovered despite desperate arbitration with the powerful Awami League Leaders was held several times. Sometimes, the police on duty also neglect to register any case against those perpetrators. Although case was registered after hectic endeavour, but the perpetrators start intimidating the victim’s family constantly. So, a sense of insecurity amongst the Hindu communities prevails. It also indicates a forceful conversion after allurement and false personification.

Similarly Ms.Nabami Sarkar –daughter of Akhil Sarkar of village Aimar Rasulpur have been the victim of fraudulent events of such circumstances and Ms.Krishna Rani and Ms. Prativa Rani of Govindapur also become target of such trend.

A process of fraudulent conversion with intent to deceive minority girls is going on with Ms.Shika Debnath daughter of Ms.Mina Debnath of village Shaljune of the same Upazila.

Police shows negative response on this particular minority issue if the case is filed at the respective police station.

As discontentment prevailed amongst Hindu minorities then the police on 1st October, 09 most reluctantly detained Ms.Purnima Roy daughter of Dulal Roy with wearing Burkha under veil covered by her face and body. Thereafter she was produced before court and the court sent her to judicial custody.

A Muslim shrewd boy got a Hindu girl- Krisna Rani Protiva into a trap in the same village of Kusumba Union of Govindapur and later abducted her and absconding. The elder brother of the victim girl protested against this sort of trap and as a result the perpetrators on behalf of the Muslim boy assaulted the victim’s brother. In this connection although case was recorded but police kept them silent. Later on the local people recovered this unfortunate girl.

The leaders of the minority community informed that police kept mum due to direct indulgence of the political leaders now in power this unfortunate fraudulent conversion is on high.

This harmful trend of fraudulent conversion of school and college going girls belonging to minorities reminded the incidents of repression of the perpetrators of four party alliances during the year, 2001-2006. Now this issue has been the subject matter of discussions amongst every body.

Advocate Nripendra Nath Mondal – President of BHBC Unity Council of Joypurhat expressed deep concern about this harmful trend of conversion while attention was drawn on this point.

As a result helpless Hindu father and mother are now in great distress with their adolescent daughters.

Sources said, ‘A time will come when it will no longer be required,’ said the shipping minister, Shahjahan Khan, as he answered a question at the BBC’s Bangladesh Sanglap at the Bangabandhu International Conference Centre on 3rd October, 2009. ‘No government wants to continue with extrajudicial killing. But we need to understand the reality. There are incidents trial of which is not possible under laws of the land,’ Shahjahan said, adding the government has no other option. He also said, ‘Nobody is interested in filing cases against the criminals who carry out terrorist act one after another. Under the circumstances what other option is left for the government?’
Three other Panelists of the dialogue and most of the audience were, however, opposed to the minister’s stand on the ‘crossfire’ as a means to end terrorist activities. In reply to a question, BNP leader Iqbal Hasan Mahmud said although the practice began during the immediate-past BNP government, it has now become clear that terrorist activities cannot be stopped even with ‘crossfire.’ ‘The practice of crossfire must be brought to an end as many good people are being killed,’ the former minister said.

Crossfire will be continue-Sheikh Hasina!
By Jahangir Alam Akash, The government of Bangladesh has taken the line extra judicial killings. Being a Prime Minister Sheikh Hasina also said extra judicial will go on. Though she was not told directly but she said indirectly clearly in favor of crossfire. It is very unfortunate for rule of law, democracy, constitution, Universal Declaration of human rights as well as the peoples of Bangladesh which was told our popular Prime Minister Sheikh Hasina in New York. Sheikh Hasina talked with journalists in New York on 27th September, 2009. In that time on ‘crossfire’ she said, “I do not believe in extrajudicial killings. There is a common consensus that very poor governance, corruption and nepotism have severely undermined the rule of law including safeguards in the constitution to protect fundamental rights. This type of killings is a criminal’s offence. But, the government hasn’t taken departmental and criminal action against those who perpetrate such killings in custody and outside.

We seem that, all the institutional system like judiciary, rule, law, regulations, and constitution, national assembly has been disabled. Not only that, the media role regarding so-called crossfire, gunfight or encounter is very bad. They only are publishing a normal report about the so-called shootout every day by the direction of RAB or police. Previous report: ‘If government wants to do continue extra judicial killings!’ http://www.humanrightstoday.info/?p=1126
But, they didn’t try to cover as an investigator or as a responsible media. Because we know very well that, media should always publish real figure facts for the peoples and its’ they’re professional duties. Every peoples have right to know. But, the media of Bangladesh didn’t show their actual duties about the murders of state.

Though, some human-rights organizations have long been asking the government to stop the killings terming them extra judicial. On the other hand, the High Court on 29th June, 2009 asked to the government to explain why killing without trial in extra judicial killings will not be declared illegal, and why departmental and criminal actions should not be taken against those who perpetrate such killings in custody and outside. After this ruling what happened,
we don’t know.
But, extra judicial killings are going on by violating the highest Court ruling. How it continuing? It’s very alarming for human rights, democracy as well as right to life. RAB was killed an alleged criminal Mohammad Ali, 25 at Mirpur outer Stadium on 18th September, 2009. Other unidentified one was killed in Chawgachha of Jessore by the police on same day. With these killing, the total of such extra-judicial killings to 42 in over six weeks from August 1 to September 18 in 2009 with them 19 such killings in August and 23 were in last 18 days.
The government of Bangladesh has been violating the constitution and Universal Declaration of Human Rights day after day since 2004. With the direction of the article 35(5) of the constitution of Bangladesh and the article 5 of the Universal Declaration of Human Rights, ‘No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment’.
And according to the article 3 of the constitution of Bangladesh ‘everyone has the right to life, liberty and security of person.’ But in practice in Bangladesh has no right to life and not executed the Universal Declaration of human rights and the Constitution of Bangladesh.

If Bangladesh wants to introduce own self as a civilized country to the world then must be follow strictly to the Universal Declaration of human rights and the Constitution of Bangladesh.
Bangladesh government has taken dualism regarding extra judicial killings. They say to the international community that in Bangladesh has no extra judicial killings. On the other side, every day in Bangladesh was happened extra judicial killings in the name of so-called crossfire, gunfight or encounter.
So we could say that the present government of Bangladesh is a liar. Because, before the last general election they told to the nation openly that, ‘if they would form power then they must stopped the extra judicial killings’. But, now it’s going on. We strongly condemned about the attitude of government regarding extra judicial killings.
If the government wants betterment of Bangladesh and if they believe rule of law, constitution and Universal Declaration of Human Rights then they could firstly established rule of law. We want to say to the government please stop the extra judicial killings and should immediately start to trial against the war criminals. We believe that otherwise wouldn’t stop the Islamic militancy. 20.9.2009

RAB and my Journalism:
In reply, I told him that “it is up to the head office.” Major Rashid became annoyed with me and said, “You broadcasted this report intentionally.” I replied, “It is my professional duty, nothing more than that.” He asked, “Why did you broadcast someone crying and the statements of Benazir’s wife and daughter?” In response, I asked him, “Do you want to know it officially?”
At this stage, Major Rashid became very rude.
The RAB would like to be able to kill me, and officially call the killing a “crossfire” or “encounter.”
RAB sent me to the local police with the charge under the section 16(2) of Emergency Power Rules 2007. I felt I was being prepared to be killed in a “crossfire” or “encounter.”
There is more shocking news I have learned about a key perpetrator, Major Rashidul Hassan Rashid, an RAB military officer who played the leading role in the extrajudicial killings of Ahsan Habib Babu, a student’s league leader; Kamrul Islam, alias Maznu Sheikh, a Workers Party leader; Ali Jafor Babu, a prominent businessman; and about twenty others.

It’s a black chapter?
By Jahangir Alam Akash, Why the conscious citizens of Bangladesh have been silent on extra judicial killings? We don’t know. Every day, the law enforcers are violating to the constitution, law, international treaty in Bangladesh. In last government regime both army backed caretaker and BNP-Jammat those were shouted against extra judicial killings now they are totally silent. Though, a few human rights organization and personalities are still shouting against this sensational issue. But, it is very exceptional.
What are doing by RAB in Bangladesh in the name of combating the terrorism? I am a close eye witness regarding state torture. RAB wanted to kills me in the name of so-called crossfire or encounter or gunfight. But, fortunately still I am in alive. I seem every movement that, I was obtained a new life.
Article 3 of the Universal Declaration of Human Rights guarantees the rights to life, liberty and security of person. Not only that, article 35(5) of the Constitution of Bangladesh has guarantees against torture. In spite of, in Bangladesh has going on torture and killings by the state.

Now stands extra judicially killed peoples totally 94 from January, 7 to September 26, 2009 in Bangladesh. Our demand is that, the government should immediately stop all types of extrajudicial killings as well as human rights violation.

But if anyone launches an armed attack (on a law-enforcer), then none can get killed like sitting ducks.” Source: Bdnews24.com

So, now we can say that, BNP-Jammat government was correct regarding crossfire? What about her (Sheikh Hasina) expression in this point, nation wants to know. Before her, Home Minister and state minister for Home were told same words.

Previous report: ‘No right to life and human rights’! By Jahangir Alam Akash, In Bangladesh has no right to life. Actually in practice there are no human rights. Almost every day peoples has been killed in extra judicial killings by so-called elite force Rapid Action Battalion (RAB) or by police.

Mohammad Ali was killed at around 2:45am. Unidentified accused mugger was killed at Jessore-Chawgachha road at about 2:00am. Source: the daily Star, 19th September, 2009.
Government source told, 577 people were killed in extra judicial killings in 472 incidents until August 31, 2009 since the formation of the elite force RAB on March 26, 2004 in the regime of BNP-Jammat.

When I was being tortured I was being shouted at with words like: “Will you do the Benazir report again…?” “Litchi garden report again…” ‘Khairuzzaman Liton’s family report again…” Now face the consequences; son of a pig… son of a bitch…” etc. The RAB would like to be able to kill me, and officially call the killing a “crossfire” or “encounter.”
RAB sent me to the local police with the charge under the section 16(2) of Emergency Power Rules 2007. I was under medical attention in the Rajshahi central jail for 10 days.
